Lorna Kennedy is a Partner in the Litigation and Dispute Resolution Department. Lorna joined Dillon Eustace in 1998 and became a partner in 2001. She specialises in personal injuries litigation and has conducted litigation on behalf of national and international corporations.

Lorna acts for insurers dealing with a broad range of matters – including coverage issues, defending personal injury and fatality claims together with product liability issues.

Lorna's representative transactions include:

  • Nolan v Wirenski [2016] IECA 56 - Appeal against a judgment in a High Court personal injury action to the Court of Appeal - The appellate court examined whether the award of damages was proportionate to the injuries sustained by the plaintiff and whether it constituted an erroneous estimate of damages. The appellate court laid out the method for Judges to follow when assessing damages in personal injuries cases.
  • Representing an insurer in Lipinski (a Minor) v Whelan [2022] IEHC 452, in which the court noted that the Personal Injury Guidelines set out the procedure or roadmap that a trial judge must have regard to when considering the effect of multiple injuries on the level of damages to be awarded.
  • Managed a successful appeal of a High Court Order to the Court of Appeal which resulted in a reduction of 50% of the award.
  • Investigating and defending fraudulent and exaggerated claims.
  • Advising insurers in relation to various aspects of motor insurance law.
  • Advising an insurer on a major product liability claim in relation to cranes.
  • Defending insurers in quadriplegic and paraplegic personal injury claims.
  • Negotiating settlements resulting in significant savings for insurers.
