Jamie Ensor specialises in Insolvency and Corporate Recovery.

Jamie is a Partner who leads our Restructuring and Insolvency team. He acts for insolvency practitioners, secured and unsecured creditors, companies, shareholders and directors in all aspects of restructuring and insolvency including; examinerships, Part 9 schemes of arrangements, receiverships, liquidations and bankruptcies. Jamie also represents domestic and foreign banks as well as non-bank lenders in relation to their security enforcement and distressed asset recovery actions. He has extensive experience in complex litigation before the superior courts arising from those restructuring or insolvency mandates.

Jamie also lectures on restructuring on the Law Society of Ireland’s Professional Practice courses. He has contributed to a number of publications including co-authoring the current edition of the Irish chapter of the Asset Tracing and Recovery Review. Jamie is consistently endorsed and ranked in his field by Chambers Europe, IFLR 1000 and Legal 500, including in the current editions of each.

Representative transactions include having advised or advising:

  • An ad hoc syndicate of international institutional secured lenders to Nordic Aviation Capital (largest regional aircraft lessor in the world) in relation to its ongoing restructuring through chapter 11 in the US.
  • A number of creditors in the examinership of Norwegian Air.
  • An indenture trustee with respect to a series of guaranteed noteholders claims in the examinership of Mallinckrodt Plc (noteholders claims of c. USD $1 billion).
  • The security trustee for several series of unsecured notes totalling approximately USD $7.4 billion in the examinership of Weatherford International Plc.
  • The investor in the examinership of Compu b.
  • The purchaser of the assets of USIT group out of liquidation.
  • NAMA on the insolvency aspects of a number of its loan portfolio sales, including Project Arch, Project Emerald / Ruby and Project Gem.
  • A liquidator in ongoing Commercial Court proceedings, prosecuting a claim for Missing Trader Intra-Community VAT fraud (MTIC Fraud) against certain stakeholders.
  • NAMA appointed statutory receiver over a large redevelopment site located in the centre of a provincial city.
  • The examiner in the examinership of Columba Books Limited, Basta Parsons Limited, I Supply Limited and Eastern Seaboard Bar & Grill Limited.
  • Goldman Sachs, CarVal, Lone Star and Deutsche Bank on the insolvency aspects of their acquisition of a number of loan portfolios.
  • Receivers from all the major accountancy firms in their appointments as receivers over a broad range of asset classes including appointments over hotels, trading companies, incomplete housing developments, farms, commercial premises and shopping centers as well as acting in the wide range of litigation before the superior courts arising from such appointments.
  • A US institutional creditor in the bankruptcy of Sir Anthony O’Reilly, including with regard to associated litigation in Ireland arising from his bankruptcy in the Bahamas.
  • Secured lenders and receivers in successfully defending challenges by debtors to the validity of the appointment of receivers over those debtors’ assets and acting for receivers in injunction proceedings restraining debtors from interfering with the receivers’ work.
