Partner Conal Keane wins judgment in the Grand Court Financial Services Division
In a comprehensive Judgment which was released in the Cayman Islands in July, Mr Justice Segal of the Grand Court Financial Services Division granted a permanent injunction in favour of IGCF SPV 21 Limited following its application for various anti-suit reliefs pursuant to a breach of contract. The Judgment followed an earlier decision of the Grand Court in February 2023 in which interim injunctive relief had been granted pending a full hearing.
While the permanent injunctive orders have been stayed pending a hearing on ancillary matters to be held in October, the decision is a positive affirmation of the contractual rights of IGCF SPV 21 Limited. More broadly, the Judgment contains detailed analysis on the Cayman Court’s approach to applications seeking anti-suit relief.
