Competition and EU Law

Our Competition and EU team provides commercially focused competition law advice to its clients. We take a proactive approach to ensuring that our clients’ commercial agreements and business transactions comply fully with EU and Irish competition law requirements.

We advise on all aspects of EU law relating to the free movement of goods and services across all business sectors.

Our team specialises in the provision of legal advice on mergers, acquisitions and joint ventures and their notification to the relevant competition authorities. We have broad experience in proposing legal solutions to ensure that our clients avoid infringement of both EU and Irish competition laws. We provide advice on a wide range of competition law matters, including:

  • competition compliance
  • advice, including staff and management training programmes, on dawn raids carried out by national and EU competition enforcement authorities

Our Competition and EU team also houses specialist knowledge and experience in the provision of sector-specific competition law advice to clients, particularly in the fields of telecommunications and energy.

Recent transactions include:

  • providing all commercial law support to Tesco Mobile on the launch of Ireland’s first mobile virtual telecommunications operator together with ongoing legal and telecommunications regulatory support
  • advising Vivas Health (now Hibernian Health), the third entrant to the Irish private health insurance market, on all regulatory matters affecting competition including correspondence with Irish and EU competition enforcement agencies
  • advising Aer Arann in relation to its correspondence with the European Commission in relation to competition issues in the Irish aviation sector
  • providing Falcon Holidays with commercial, electronic communications and competition law advice on the distribution of package holidays, and
  • advising Tele 2 Denmark in relation to its communications with the European Commission on competition in the Danish telecommunications sector.
