PROFILE: Elaine joined Dillon Eustace in 2010 and currently works in the Litigation and Dispute Resolution Department. Elaine’s practice covers a broad range of litigation and advisory work. Elaine deals with the conduct of defence insurance litigation on behalf of national and international insurance companies in the area of motor claims, employer’s liability, public liability and product liability claims. She also represents a number private healthcare organisations and nursing homes in the defence of medical negligence claims. She carries out advisory work for insurers on the practical implications of new legislation and cost saving measures in the claims arena.

Elaine is a regular speaker at in-house CPD sessions with various insurance companies and lectures at the Insurance Institute of Ireland. She has published a number of articles in the Irish Medical Times.

REPRESENTATIVE ACTIONS:

Defending High Court, Circuit Court and District Court actions arising from medical negligence claims, occupier’s liability claims, employer’s liability claims, defective products claims, defamation claims, claims under the Athens Convention and breach of contract claims on behalf of Irish and international insurers.
Managing catastrophic injury cases and assessing recoverable future losses, cost of future care, loss of earnings and pension, house adaptation costs and successfully disposing of cases on an economical basis.
Advising private healthcare organisations in respect of internal procedures and defending medical negligence actions on their behalf.
Significant experience in defending fraudulent and exaggerated claims.
Advising insurers on various aspects of motor insurance law and regulatory requirements, including Consumer Protection Legislation and Codes.
