Dillon Eustace advises the syndicate of secured lenders to Smart Telecom which recently successfully emerged from examinership. The scheme of arrangement which was recently approved by the Irish High Court provided for a write-down of a portion of one of the secured facilities owed to the secured lenders, a deferral of part of one of the facilities and a discharge of one of the facilities in return for a payment to the secured lenders.
